Este artículo analiza el proceso de integración del Mercosur en el que participan Argentina, Brasil, Paraguay y Uruguay y sus efectos sobre la ciudadanía política y social. En la primera parte del mismo los autores examinan los rasgos, el contexto de nacimiento y la filosofía del proceso de integración mercosureño. La segunda parte analiza la evolución de la democracia y de la justicia social durante el proceso de integración. Los autores llegan a la conclusión de que el modelo de integración (...) mercosureño no puede contrarrestar la crisis de la democracia y de la justicia social que tienen lugar especialmente en Argentina y Brasil. En esta contribución se analizan dos grandes períodos de la obra intelectual de Pietro Barcellona. El primero se corresponde con sus originarias reflexiones sobre los distintos usos del derecho, en el sentido de la transformación-adecuación de las instituciones y del ordenamiento jurídico italiano de la postguerra con los principios de la Constitución de 1948. De este primer período hay que destacar sus investigaciones sobre el uso alternativo del derecho y de los lazos de funcionalidad existentes entre el Estado, la economía (...) y el derecho. En el segundo período, se analiza el tránsito del pensamiento barcelloniano hacia las cuestiones que deben enriquecer un concepto de democracia plena de sentido para un individuo cada vez más alienado, sometido a la lógica de lo económico y, por tanto, menos libre y autónomo. Barcellona afronta esta última cuestión analizando los fundamentos de la Modernidad, para comprender principalmente dos cosas: a) el destino del individuo en esta fase de la sociedad occidental, y b) saber cómo ha logrado la burguesía, a través de qué principios y formas, consolidar y reproducir su hegemonía social en la sociedad moderna. En esta etapa el siguiente trabajo se centra, en primer lugar, en su teoría del individualismo propietario y en la crítica al "derecho igual", para después, en un segundo momento, plantear sus propuestas acerca de la política y de la democracia como forma de vida. Todo el análisis de la obra de Barcellona, considerada por los autores del siguiente ensayo, como fundamental para entender diversos aspectos jurídico-políticos de las sociedades post-industriales, ha sido desarrollado respetando el orden cronológico de la producción intelectual de Barcellona a lo largo de los dos períodos tratados. La aprobación en junio de 2008 por el Parlamento Europeo de la Directiva de retorno —denominada también Directiva de la infamia o Directiva de expulsión— consolida el proceso de involución que sobre los derechos humanos se viene produciendo en la Unión Europea desde que el miedo a la inmigración irregular se incardinó en sus instituciones. Si bien las legislaciones de extranjería de los años ochenta contenían normas que regulaban el internamiento y la expulsión no es hasta la Directiva 2001/40/CE que (...) comienza a tomar forma una política comunitaria centrada en la inmigración irregular y las expulsiones de migrantes. Las medidas de retorno son, dice la Comisión europea, “una piedra angular de la política de migración de la UE”. Desde entonces, la barbarie de los centros de retención e internamiento, el socavamiento de los derechos y la exclusión y criminalización de los migrantes extranjeros se han convertido en el caballo de batalla de las asociaciones defensoras de los derechos humanos. La erosión que las legislaciones y medidas de expulsión están provocado en los derechos y libertades y en las instituciones del Estado de derecho es inmensa. El retroceso y la erosión en los derechos y libertades es tan grande que ya no es posible continuar hablando sin más de Estados de derecho en la UE, sino más bien de máquinas administrativas para el internamiento y la expulsión, de “Estados expulsores” (1), donde las personas extranjeras son tratadas como semipersonas (2) e incluso como “no-personas” (3). La actividad teórica y la actividad práctica han sido tradicionalmente entendidas como complementarias en el sentido que mediante la actividad teórica el sujeto se apropiaría idealmente de los objetos del mundo externo, mientras que mediante la actividad práctica realizaría sus propias metas subjetivas en el mundo. Sin embargo, dicho modelo plantea un conjunto de graves problemas exegéticos y conceptuales sobre la estructura y significado de la entera filosofía del espíritu de Hegel. En este artículo buscaremos esclarecer qué es a ojos (...) de Hegel lo propiamente específico de la actividad teórica y de la actividad práctica, para, sobre esa base, ofrecer un modelo exegético que logre dar satisfactoriamente cuenta de la particular periodización general que Hegel propone sobre las diferentes formas de actividad del espíritu humano. Inicialmente, proponho a discussão sobre as justificativas que são fornecidas para o ensino de humanidades. Analiso, em seguida, algumas dessas justificativas a partir de suas raízes filosóficas que julgo remontarem a Aristóteles e a Hegel. Identifico na estratégia enciclopédica desse último, o tipo de argumento mais usual para legitimar o ensino de humanidades ainda hoje. Indico, na seqüência, os motivos pelos quais nenhuma dessas justificativas possui, nos nossos dias, poder de convencimento. Finalmente, utilizando o diagnóstico de Lyotard sobre o mundo (...) contemporâneo, indico uma maneira alternativa de tornar o ensino de humanidades necessário sem fazer referência ao humanismo. Assim, não se reivindica nesse artigo nenhum gesto de independência com relação à filosofia de matriz europeia. Embora isso seja legítimo, trata-se sempre de um tipo frágil de argumentação, uma crítica externa de pouca capacidade de convencimento. Aqui preferimos defender a necessidade de um ajuste do trabalho filosófico em função da falência dos procedimentos filosóficos tradicionais pela pós-modernidade. Even though the link between perceived corporate social responsibility fit and corporate reputation has received much attention from scholars, this tradition has ignored that the underpinnings of this association vary depending on the particular characteristics of each industry under study. To delve into this matter, we investigate in the increasingly relevant context of controversial industries how PCSR-fit could enhance corporate reputation and which are the mediating mechanisms of this association. Our academic contribution is twofold. First, we find that controversial sectors (...) indeed can increase corporate reputation through CSR activities. However, we find that to achieve this goal, the nature of PCSR-fit should be different than what extant literature indicates, because companies in these settings should directly focus on avoiding or reducing their inherent controversial harm or impact. Second, we evidence that “CSR initiatives' legitimacy” and “situational skepticism” mediate the PCSR-fit and corporate reputation relationship in CIs. Therefore, we further unravel the underpinnings of this association to advance what we know on the matter and aid practitioners in this particular context. (shrink)

Medical practice is ideally based on robust, relevant research. However, the lack of disease-modifying treatments for Alzheimer’s disease has motivated “innovative practice” to improve patients’ well-being despite insufficient evidence for the regular use of such interventions in health systems treating millions of patients. Innovative or new non-validated practice poses at least three distinct ethical questions: first, about the responsible application of new non-validated practice to individual patients ; second, about the way in which data from new non-validated practice are communicated (...) via the scientific and lay press ; and third, about the prospect of making new non-validated interventions widely available before more definitive testing. We argue that the authors of metabolic enhancement protocols for Alzheimer’s disease have overstated the evidence in favor of these interventions within the scientific and lay press, failing to communicate weaknesses in their data and uncertainty about their conclusions. Such unmeasured language may create false hope, cause financial harm, undermine informed consent, and frustrate the production of generalizable knowledge necessary to face the societal problems posed by this devastating disease. We therefore offer more stringent guidelines for responsible innovation in the treatment of Alzheimer’s disease. (shrink)

O presente texto traz uma análise do negacionismo a partir da junção da Análise Crítica do Discurso – de maneira mais específica aquela que institui o raciocínio dialético como metodologia (Fairclough, 2015; 2018) – em interface com a Linguística de Corpus, inspirado no trabalho de Magalhães (2004), em sua abordagem de palavras-chave (Williams, 1976), para análise de corpus de pequena dimensão (Sinclair, 2001). A partir desse aporte, buscamos analisar um corpus de textos midiáticos sobre negacionismo, como contribuição para averiguar as (...) relações lexicais que constroem uma argumentação e uma série de articulações que procuram sustentá-lo, bem como indicar os vieses com os quais ele se conecta numa tentativa fundante de desconstrução de saberes instituídos como o da ciência. Como resultado, percebemos a fragilidade do negacionismo, mas o perigo que representa ao sair do universo das ideias para o universo do comportamento, na forma de negação sem argumentação plausível ou com ela fragilizada e sem uma validação de propostas, gerando um ambiente insalubre para todos, especialmente para os próprios negacionistas. Accountability is a cornerstone of the governance of artificial intelligence (AI). However, it is often defined too imprecisely because its multifaceted nature and the sociotechnical structure of AI systems imply a variety of values, practices, and measures to which accountability in AI can refer. We address this lack of clarity by defining accountability in terms of answerability, identifying three conditions of possibility (authority recognition, interrogation, and limitation of power), and an architecture of seven features (context, range, agent, forum, standards, process, (...) and implications). We analyse this architecture through four accountability goals (compliance, report, oversight, and enforcement). We argue that these goals are often complementary and that policy-makers emphasise or prioritise some over others depending on the proactive or reactive use of accountability and the missions of AI governance. Este es un ensayo fotográfico que, ante el deterioro del fondo habitacional de Centro Habana, Cuba, se pretende construir un archivo tipológico de las decoraciones con azulejos o baldosas hidráulicas vidriadas, aún visibles en algunas edificaciones, mediante la fotografía documental, para preservar lo que alguna vez fuera parte de la vida cotidiana de residentes y transeúntes, y que ha sido reconocido por los especialistas como parte del patrimonio de la ciudad.

The present article is framed within the biosemiotic glossary project as a way to address common terminology within biosemiotic research. The glossary integrates the view of the members of the biosemiotic community through a standard survey and a literature review. The concept of ‘semiotic threshold’ was first introduced by Umberto Eco, defining it as a boundary between semiotic and non-semiotic areas. We review here the concept of ‘semiotic threshold’, first describing its denotation within semiotics via an examination on the history (...) of the concept, its synonyms, antonyms, etymology, usage in other languages and context in which it is used. Then we present a general overview of the survey among researchers, analyzing the difference in responses for the concept of ‘lower semiotic threshold’ and related concepts. From the answers we also review the difference between the general usage of ‘semiotic threshold’ versus its specific use within biosemiotics, and attempt to make a general synthesis of the concept taking into account what we have learned from the survey and the literature review. The EU Artificial Intelligence Act (AIA) defines four risk categories for AI systems: unacceptable, high, limited, and minimal. However, it lacks a clear methodology for the assessment of these risks in concrete situations. Risks are broadly categorized based on the application areas of AI systems and ambiguous risk factors. This paper suggests a methodology for assessing AI risk magnitudes, focusing on the construction of real-world risk scenarios. To this scope, we propose to integrate the AIA with a framework developed by (...) the Intergovernmental Panel on Climate Change (IPCC) reports and related literature. This approach enables a nuanced analysis of AI risk by exploring the interplay between (a) risk determinants, (b) individual drivers of determinants, and (c) multiple risk types. We further refine the proposed methodology by applying a proportionality test to balance the competing values involved in AI risk assessment. Finally, we present three uses of this approach under the AIA: to implement the Regulation, to assess the significance of risks, and to develop internal risk management systems for AI deployers. This volume serves as a reference on the field of cognitive semantics. It offers a systematic and original discussion of the issues at the core of the debate in semiotics and the cognitive sciences. It takes into account the problems of representation, the nature of mind, the structure of perception, beliefs associated with habits, social cognition, autism, intersubjectivity and subjectivity. The chapters in this volume present the foundation of semiotics as a theory of cognition, offer a semiotic model of cognitive (...) integration that combines Enactivism and the Extended Mind Theory, and investigate the role of imagination as the origin of perception. The author develops an account of beliefs that are associated with habits and meaning, grounded in Pragmatism, testing his Narrative Practice Semiotic Hypothesis on persons with autism spectrum disorders. He also integrates his ideas about the formation of the theory of mind with a theory of subjectivity, understood as self-consciousness which derives from semiotic cognitive abilities. El objetivo de este artículo es presentar una reconstrucción de la teoría de los grupos dereferencia. La teoría, desarrollada por Robert K. Merton, ha sido largamente utilizada enlos más variados campos de las ciencias sociales, aunque con escasa o nula consideraciónmetateórica hasta ahora. La reconstrucción atenderá a la presentación que de la misma serecoge en sendos artículos de su libro Social Theory and Social Structure, de 1968, a saber:“Contributions to the theory of reference group behavior” y “Continuities in the theory (...) ofreference groups and social structure”. Para presentar esta reconstrucción me apoyaré en elinstrumental de la Metateoría Estructuralista. Después de una consideración informal de lateoría, serán presentados sus modelos potenciales, modelos, modelos potenciales parciales,sus aplicaciones intencionales y algunos comentarios acerca de la noción de “grupo de referencia”en lo que respeta su carácter relacional y disposicional. The EU proposal for the Artificial Intelligence Act (AIA) defines four risk categories: unacceptable, high, limited, and minimal. However, as these categories statically depend on broad fields of application of AI, the risk magnitude may be wrongly estimated, and the AIA may not be enforced effectively. This problem is particularly challenging when it comes to regulating general-purpose AI (GPAI), which has versatile and often unpredictable applications. Recent amendments to the compromise text, though introducing context-specific assessments, remain insufficient. To address this, (...) we propose applying the risk categories to specific AI scenarios, rather than solely to fields of application, using a risk assessment model that integrates the AIA with the risk approach arising from the Intergovernmental Panel on Climate Change (IPCC) and related literature. This model enables the estimation of the magnitude of AI risk by considering the interaction between (a) risk determinants, (b) individual drivers of determinants, and (c) multiple risk types. Studying the origin of semiosis is a task obscured by terminological and metaphysical issues which create an ambiguous set of definitions for biosemiotics when referring to the concept of emergence. The question is, how emergent can semiosis be? And what are the conditions for semiosis to be an emergent of a certain type? This paper will attempt to briefly deal with the general terminology of emergence from a philosophical point of view and will discuss the characterization of semiosis as an (...) emergent phenomenon based on the distinctions made by Bedau, Kim and Chalmers. Accordingly, we will consider the possibility of strong and weak emergence in an attempt to bring some clarity to what it means for something in biosemiotics to be an emergent and how the philosophical concepts play out when applied to biosemiotic research. In inquiring into the metaphysical status of semiosis, we change our semiotic theories to correspond to the assumptions contained in the elementary objects of our theories. This being the case, the way semiosis–the constitutive element that it is for semiotics–is taken to be with regards to its possible ontology, will conduct to different research objects for the long-term investigation of its origins and necessary conditions. Financiamento de Pesquisa: CNPq Moral e Direito: uma relação peculiar Resumo: O objetivo deste artigo é defender a existência de uma relação peculiar pluridirecional entre a moral e o direito, bem como defender que a moralidade é melhor compreendida por sua autoridade normativa em segunda pessoa, especificamente nos casos que envolvem reivindicações de justiça. Para tal finalidade, inicio esclarecendo as características centrais da moralidade, ressaltando a sua natureza e autoridade normativa intersubjetiva. Posteriormente, investigo duas reivindicações de justiça, a saber, a (...) injustiça epistêmica e a desobediência civil. Na conclusão, sugiro uma distinção entre moralidade privada e pública, argumentando que isto pode nos ajudar a compreender melhor a relação pluridirecional que existe entre a moral e o direito. Morals and Law: a peculiar relationship Abstract: The main aim of this paper is to defend the existence of a peculiar pluridirectional relationship between morals and law, as well as to defend that morality is better understood by its normative authority in second person, specifically in cases involving claims of justice. To this end, I begin by clarifying the central characteristics of morality, highlighting its nature and its normative authority that is intersubjective. Subsequently, I investigate two claims of justice, namely, epistemic injustice and civil disobedience. In conclusion, I suggest a distinction between private and public morality, arguing that this can help us to better understand that there is a pluridirectional relationship between morals and law. This commentary draws upon the author's experience in bioethics and as a physician, ordained Rabbi, and certified Mohel (a Jewish professional qualified to perform infant male circumcisions (MC)). People's identity and adherence to a religious belief are frequently cited reasons for deciding whether to circumcise their male children. For Jewish and Muslim males, circumcision is considered essential. In this commentary, the author uses his medical, religious, and bioethical knowledge, expertise, and experience to address common arguments used in opposing nontherapeutic male (...) circumcision of minors. In these narratives, half of the parents agreed with circumcision, and half did not. The parents against circumcision cite human rights violations, security, privacy, and bodily integrity issues and refer to circumcision as genital mutilation, while those who agree argue that circumcision should be done for religious reasons to prevent health issues, promote hygiene and cleanness, avoid cancer, or for later sexual enjoyment. After evaluating the evidence, the author states that parents should be free to either consent or decline MC for a son. Though a reoccurring theme in these narratives was for mothers to leave the circumcision decision up to their male partners, the author concludes that women have considerable power regarding the decision. Those of us who have followed Fred Dretske's lead with regard to epistemic closure and its impact on skepticism have been half-wrong for the last four decades. But those who have opposed our Dretskean stance, contextualists in particular, have been just wrong. We have been half-right. Dretske rightly claimed that epistemic status is not closed under logical implication. Unlike the Dretskean cases, the new counterexamples to closure offered here render every form of contextualist pro-closure maneuvering useless. But there is a (...) way of going wrong under Dretske's lead. As the paper argues, Cartesian skepticism thrives on closure failure in a way that is yet to be acknowledged in the literature. The skeptic can make do with principles which are weaker than the familiar closure principles. But I will further claim that this is only a momentary reprieve for the skeptic. As it turns out, one of the weaker principles on which a skeptical modus tollens must rest can be shown false. (shrink)

Given two (positive) equivalence relations ∼ 1 , ∼ 2 on the set ω of natural numbers, we say that ∼ 1 is m-reducible to ∼ 2 if there exists a total recursive function h such that for every x, y ∈ ω, we have $x \sim_1 y \operatorname{iff} hx \sim_2 hy$ . We prove that the equivalence relation induced in ω by a positive precomplete numeration is complete with respect to this reducibility (and, moreover, a "uniformity property" holds). This (...) result allows us to state a classification theorem for positive equivalence relations (Theorem 2). We show that there exist nonisomorphic positive equivalence relations which are complete with respect to the above reducibility; in particular, we discuss the provable equivalence of a strong enough theory: this relation is complete with respect to reducibility but it does not correspond to a precomplete numeration. From this fact we deduce that an equivalence relation on ω can be strongly represented by a formula (see Definition 8) iff it is positive. At last, we interpret the situation from a topological point of view. Among other things, we generalize a result of Visser by showing that the topological space corresponding to a partition in e.i. sets is irreducible and we prove that the set of equivalence classes of true sentences is dense in the Lindenbaum algebra of the theory. Há um esforço de parte da comunidade filosófica latino-americana em realizar uma aproximação com relação ao nosso ambiente cultural. Esse esforço não exige exclusividade na definição de uma agenda filosófica latino-americana, mas permite uma série de alternativas. Na maioria das iniciativas para realizar a aproximação entre a filosofia e a cultura da América Latina tem prevalecido as disposições de afastamento epistemológico que são típicas de uma abordagem crítica. Porém, esta última oculta armadilhas que tendem a inviabilizar os projetos de diálogo (...) propostos. Isso ocorre justamente porque, a despeito das intenções de estabelecer aproximação e diálogo com relação à América Latina, a crítica interpõe afastamento. Assim, o objetivo principal desse texto é indicar as limitações da crítica como dispositivo de aproximação entre a filosofia e a cultura latino-americana e indicar alternativas para superá-las. Sem realizar sacrifícios ligados às disposições críticas herdadas da filosofia europeia, não será possível obter a desejada pertinência filosófica com relação à América Latina. The zone of latent solutions hypothesis provides an alternative approach to explaining cultural patterns in primates and many other animals. According to the ZLS hypothesis, non-human great ape cultures consist largely or solely of latent solutions. The current competing hypothesis for ape culture argues instead that at least some of their behavioural or artefact forms are copied through specific social learning mechanisms and that their forms may depend on copying. In contrast, the ape ZLS hypothesis does not require these forms (...) to be copied. Instead, it suggests that several social learning mechanisms help determine the frequency of these behaviours and artefacts within connected individuals. The ZLS hypothesis thus suggests that increases and stabilisations of a particular behaviour’s or artefact’s frequency can derive from socially-mediated form reinnovations. Therefore, and while genes and ecology play important roles as well, according to the ape ZLS hypothesis, apes typically acquire the forms of their behaviours and artefacts individually, but are usually socially induced to do so. The ZLS approach is often criticized—perhaps also because it challenges the current null hypothesis, which instead assumes a requirement of form-copying social learning mechanisms to explain many ape behavioural forms. However, as the ZLS hypothesis is a new approach, with less accumulated literature compared to the current null hypothesis, some confusion is to be expected. Here, we clarify the ZLS approach—also in relation to other competing hypotheses—and address misconceptions and objections. L'auteur part de la définition la plus intuitive du concept de neutralité pour présenter quatre thèses qui se sont révélées comme des acquis du débat. Ces thèses affirment : 1) que la neutralité est un concept politique et non pas moral ; 2) qu'elle vise les justifications de l'action de l'État et non pas ses conséquences ; 3) qu'elle n'oblige pas nécessairement l'État à s'abstenir d'agir ; et 4) qu'elle est avant tout neutralité envers les individus et seulement de manière (...) dérivée neutralité envers les conceptions du bien. Ensuite, l'auteur discute deux affirmations qui jouissent d'une popularité aussi forte que les précédentes mais qui sont beaucoup moins évidentes. La première est qu'il y a des liens profonds entre l'idée de neutralité et l'idée d'égalité. La deuxième est qu'il y a un rapport d'équivalence entre le concept de neutralité et celui d'anti-perfectionnisme. Mettre en question cette dernière affirmation implique une prise de distance par rapport à quelques argumentations bien connues en faveur de la neutralité, mais cette opération s'impose si on veut répondre aux critiques de ceux qui proposent l'abandon de cette exigence normative.The article presents four theses that can be seen as firm outcomes of the contemporary debate on the principle of neutrality. These theses affirm that 1) neutrality is a political concept, not a moral one ; 2) neutrality involves the justifications of the State's action, not its consequences ; 3) neutrality does not imply State's inactivity ; and 4) State's neutrality is before anything neutrality between individuals and it is only afterwards between conceptions of the good. The second part of the article discusses two widely accepted but far more controversial statements. The first one says that there are deep links between neutrality and equality. The second one ajfirms that neutrality and anti-perfectionism are equivalent. To challenge the latter implies to reject some of the most popular cases for neutrality. However, this is needed if one wants to react to the great criticism coming from enemies of this principle. (shrink)
